Welcome to Uvisoft Technology Private Limited. This Cancellation & Refund Policy outlines the terms and conditions related to cancellations, refunds, service modifications, and termination of services provided by Uvisoft Technology Private Limited (“Uvisoft”, “Company”, “we”, “our”, or “us”).

By purchasing or using any of our services, you agree to the terms mentioned in this policy.

At Uvisoft Technology Private Limited (“Uvisoft”), we are committed to providing excellent services to our clients. This Refund and Cancellation Policy outlines the terms and conditions under which refunds and cancellations are processed for the services we offer. By using our services, you agree to the terms stated below.


1. Cancellation of Services

1.1 Client-Initiated Cancellations

Clients may request cancellation of services by submitting a written request via email to Uvisoft at least 7 days prior to the scheduled commencement of the service.

  • If cancellation is requested before the project or service begins, Uvisoft may review the request and process it according to the agreement terms.
  • If the cancellation request is made after the project or service has commenced, the client will be responsible for payment of all work completed, resources utilized, and expenses incurred up to the date of cancellation.
  • Any third-party costs, software licenses, hosting charges, domain registrations, advertising spends, or vendor payments already made on behalf of the client are non-refundable.

1.2 Uvisoft-Initiated Cancellations

Uvisoft reserves the right to cancel, suspend, or terminate any service or agreement under circumstances including but not limited to:

  • Violation of terms and conditions
  • Non-payment or delayed payment
  • Misuse of services
  • Client non-cooperation
  • Submission of illegal, offensive, or prohibited content
  • Technical or operational limitations
  • Unforeseen circumstances beyond reasonable control

In such cases, if applicable, the client may receive a refund only for the unfulfilled portion of the service, subject to internal review and approval.


2. Refund Policy

2.1 Eligibility for Refund

Refunds may be considered only under the following conditions:

  • Uvisoft fails to initiate or deliver the agreed service due to internal operational issues.
  • The service cannot be completed due to reasons directly attributable to Uvisoft.
  • Duplicate payments or accidental overpayments made by the client.

Refund requests must be submitted in writing to the official company email along with supporting details.

2.2 Non-Refundable Services

The following services are strictly non-refundable once work has commenced, resources have been allocated, or deliverables have been shared:

  • Digital Marketing Services
  • Branding & Creative Design Services
  • Website Design & Development
  • E-Commerce Development
  • Software Development
  • Mobile App Development
  • VR/AR Development Solutions
  • SEO Services
  • Social Media Management
  • Advertisement Campaign Management
  • Domain Registration & Hosting
  • Custom Software Solutions
  • LMS & ERP Development
  • AI Solutions & Automation Services
  • Graphic Design & Video Editing
  • Consulting & Technical Support Services

Additionally:

  • Advance payments, booking fees, retainers, and deposits are non-refundable unless explicitly mentioned otherwise in a separate written agreement.
  • No refunds will be provided once the project has been completed, delivered, approved, or accepted by the client.
  • Refunds are not applicable for delays caused by client-side dependencies, delayed approvals, lack of communication, or force majeure events.

2.3 Refund Process

If a refund request is approved:

  • Refunds will be processed within 7 business days from the date of approval.
  • Refunds will be issued through the original payment method wherever possible.
  • Uvisoft reserves the right to deduct administrative charges, payment gateway charges, taxes, third-party expenses, and costs incurred during the execution of the service.

The final decision regarding refunds shall remain solely at the discretion of Uvisoft Technology Private Limited.


3. Modifications and Change Requests

3.1 Service Modifications

Any request for changes, revisions, or modifications after project approval may:

  • Result in additional charges
  • Extend the project timeline
  • Require a revised quotation or agreement

Uvisoft reserves the right to evaluate the scope of additional work before accepting modification requests.

3.2 Change in Project Scope

If the client requests work outside the agreed scope, timeline, or deliverables, such requests shall be treated as additional services and billed separately.


4. Service Termination

Uvisoft reserves the right to terminate or suspend services immediately if:

  • The client violates any agreement or policy
  • Payment obligations are not fulfilled
  • Abusive, unethical, or unlawful conduct is identified
  • The client causes repeated delays affecting project execution

In such cases:

  • All outstanding dues become immediately payable.
  • No refund shall be provided for completed or ongoing work.
  • Access to deliverables, hosting, software, or digital assets may be suspended until dues are cleared.

5. Force Majeure

Uvisoft shall not be held liable for delays, interruptions, or failure in performance caused by events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Floods, earthquakes, or fires
  • Government restrictions
  • Internet or power failures
  • Cyber attacks
  • Pandemics
  • Labor strikes
  • Third-party service disruptions

Under such circumstances, refunds shall not be applicable. However, Uvisoft will make reasonable efforts to resume and complete services once conditions stabilize.


6. Limitation of Liability

Uvisoft’s total liability related to any service shall not exceed the amount actually paid by the client for that specific service.

Under no circumstances shall Uvisoft be liable for:

  • Indirect or consequential losses
  • Loss of business or revenue
  • Data loss
  • Reputation damage
  • Third-party claims

7. Governing Law

This policy shall be governed and interpreted in accordance with the laws of India.

Any disputes arising under this policy shall be subject to the jurisdiction of the courts located in Tiruvannamalai District, Tamil Nadu.


8. Updates to This Policy

Uvisoft reserves the right to update, modify, or revise this Cancellation & Refund Policy at any time without prior notice.
